Counterclaim

If Content in your account was suspended due to a third-party notification of alleged copyright infringement, you will receive an email notification of the claim and will receive instructions and have an opportunity to file a counterclaim.

When PigLoad.Club suspends Content for policy violations, the account holder of the Content will receive a strike for each instance. The account holder is notified of the violation via email. Repeated policy violations (multiple strikes) will result in account suspension.

A derivative work refers to creations such as mixed "tapes" where you might take shorter video sequences, images, or even sound from a recording or text or multiple recordings or text and edit it into something new.

Although the result is a new creation, the videos, images, text, or sound belong to someone else and you need permission from the copyright holder(s) of the Content you used.

If you have all the necessary rights to the Content which includes, but is not limited to, audio, video, images, text, and rights to redistribute, read on.

You may use the counterclaim to request a retraction of their claim.

WARNING: If you do not have the necessary rights to the Content, filing a counterclaim may not be appropriate! Filing a false counterclaim may lead to legal action against you and ultimately the account deactivation.

We will forward your counterclaim, which includes your personal information, to the party who submitted the original claim of copyright infringement.

By submitting a counterclaim, you consent to have your name and contact information revealed.

After receipt of the counterclaim, the claimant who filed the copyright infringement must notify us within ten (10) business days that it has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the Content on PigLoad.Club or to take back the note of infringement.

If your counterclaim is successful, the strike will be removed and the file(s) in question restored.
